Sessions Court Disposal/Carry Forward Rate
In the Sessions Court, there appears to be no formal case management unit and judges manage their own caseload. In Kuala Lumpur, one Judge described the process as follows: counsel come together with the judge to discuss the case, agree on the number of witnesses, and agree on any documentation and length of trial. A trial date is then fixed within two months. The total time period from the date the case is registered is 4-6 months. In interviews with remand prisoner, the audit team found this time-line was generally kept to.
The data shows that the 139 judges (Sessions Court) processed 195 cases each in the course of 2011, or 16 cases per month. The caseload in the Sessions Court also appears manageable.
